This document, i.e., Privacy Policy (“Policy”) contains the manner and details in which Barriq Jjewels Private Limited (“Barriq”, “we”, ‘’us”, or “our”), collects, uses, handles, processes and stores the information and data that you, the reader of this Policy (“User”, “you”, “your”), provide to Barriq, when you visit the e-commerce platform of Barriq at the URL - https://barriqjewels.com (“Platform”).
Barriq reserves the right to amend, alter, modify, and replace this Policy at any time without any prior notice to the users. Once the Policy is amended, altered, modified or replaced, Barriq will release the updated privacy policy on the Platform. The updated privacy policy will effectively substitute the original privacy policy. The User may visit the Platform to review the latest version of the Policy.
1. General
1.1. Barriq Jjewels Private Limited, a company incorporated under the Companies Act, 2013 with its registered office 17/18, Plot-47/51, Kapur Mansion, Nyaymurty Sitaram Patkar Marg, Chowpatty, Grant Road, Mumbai, Maharashtra, India, 400007 is managing and operating the Platform through which it, inter alia, facilitates the User in availing the Services and/or purchasing the Products.
1.2. This Policy, together with the Terms of Use and/or any other privacy notice or fair processing notice that we may issue or display on our Platform governs your use of the Platform and describes Barriq’s policies and procedures on the collection, use, disclosure, processing, transfer, and storage of the information provided by you. By using, browsing, accessing, or purchasing from the Platform, you agree to be bound by the terms of this Policy and consent to the collection, storage, possession, dealing, handling, sharing, disclosure or transfer of your information in accordance with the terms of the Policy. Barriq shall not use your information in any manner except as provided under this Policy. This Policy supplements the other notices and is not intended to override them and shall at all times be read in conjunction with the terms and conditions set out in Barriq’s Terms of Use. 1.3. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that requires the publication of the rules and regulations, privacy policy, and terms of use for access or usage of the Platform. This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the provisions pertaining to electronic records in various statutes as amended from time to time.
1.4. This Policy sets out the type of information collected from the users of the Platform, including the nature of the Personal Data, the purpose, means and modes of usage of such information, the manner in which and the persons to whom Barriq shall disclose or transfer such information and the rights available to the User in relation to the Personal Data provided.
1.5. If a User does not agree with any provisions of the Terms of Use or this Policy, it is advised that the User should not use or access the Platform.
We may collect and process the following data about you:
2. Type of Information Collected
2.1. Personal data means any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person and includes ‘personal information’ and ‘sensitive personal data or information’ as defined under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (“Personal Data”). It is hereby clarified that Personal Data does not include information relating to an individual which is either anonymous in nature or is not personally identifiable to a particular individual or person.
2.2. In order to provide you the Servies and Products and for the purposes as more particularly set out in clause 3, Barriq may collect a variety of information from you, including:
  • your first name;
  • your last name;
  • your mobile number;
  • your email address;
  • your residential address;
  • your date of birth;
  • your gender;
  • your password;
  • your billing address;
  • your financial information such as your PAN card, bank account details, payment information;
  • your Aadhaar card;
  • your contact preferences; and
  • information pertaining to the IP of the User such as IP address, IP browser user agent, browser location data received from GPS coordinator.
2.3. Barriq may collect such information which when combined with other pieces of information available with us could reasonably allow the User to be identified. In addition to the Personal Data that Barriq collects from the User directly, the User also consents to additional information in relation to the User being collected by Barriq from third party sources such business partners, affiliates, or publicly available sources, cookies and IP addresses for legitimate purposes including but not limited to providing efficient and expedient Services to the User.
2.4. You agree to provide information, which shall be true, correct, up to date and accurate. Barriq shall not be responsible for the authenticity of the Personal Data supplied by you to us or any other person acting on behalf of Barriq.
2.5. Barriq does not knowingly collect Personal Data from any User of the Platform who is under 18 years of age. If it comes to the knowledge of Barriq that Barriq has inadvertently collected the Personal Data of a person below the age of 18 years, Barriq agrees to take steps to delete the information. If a parent or guardian becomes aware that his or her child has provided his/ her information to Barriq without their consent, he or she shall contact Barriq for the deletion of such information. In the event, in contravention to this Policy and Terms of Use, a person below the age of 18 uses the services, Barriq shall not be held liable or responsible for any damage or injury suffered by such person.
3. Use of Information Collected
3.1. Each User provides a free, specific, informed, unconditional and unambiguous consent to Barriq to use, store, handle, process, and share information, details, documents etc. provided by such User to Barriq for the following purposes:
  • creating and providing access to the Platform;
  • undertaking KYC verification of the User;
  • developing, delivering, and improving the Products and services;
  • personalizing and enhancing User experience;
  • informing Users about new products, services, offers, trends, updates, and events, including order confirmations or cancellations;
  • sending the User promotional and marketing offers, pamphlets, brochures in relation to Barriq’s services and/or product offerings either on our own or through third party platforms;
  • receiving all communications on the mobile number provided by the User, even if the mobile number is registered under the do not disturb/national customer preference register list under the TRAI regulations;
  • answering questions or requests for information raised by the User and handling User’s complaints;
  • enabling Barriq to undertake and perform its contractual obligations;
  • internal administrative purposes, as well as to manage relationship with the User;
  • detecting, preventing and addressing technical and security issues including to combat spam, malware, malicious activities, or security risks, improve and enforce our security measures and to monitor and verify User identity so that unauthorized users do not access User accounts;
  • ensuring compliance with applicable laws and maintaining records, backups, filings and copies as required under applicable law;
  • tracking the User’s location in order to ensure that the Platform can pre-fill part of the address as detected by the current location of the device being used to access the Platform. The said tracking shall continue during the provision of the Products and Services and even in case the Platform is running in the background on some other application;
  • notifying Users about change or updates in Barriq’s products, services and/or policies; and
  • conducting internal analytical and research activities for the improvement of products, services, and customer satisfaction.
3.2. In the event the Barriq may be required to and may collect and store other personal information and/or data in addition to the Personal Data that is already being collected by us as set out in Clause 2, Barriq shall inform the Users, of such additional personal information being collected and stored, and the Users in order to continue to access the Platform must consent to the collection, storage, and processing of such additional personal information/data.
3.3. However, disclosure of the User’s information to any third party (including to Barriq delivery partners) for purposes other than the purposes as contemplated in Clause 3 and other incidental and ancillary purposes thereto, shall be subject to the User’s prior consent.
4. Disclosure of Information Collected
4.1. Barriq may, from time to time, be required to disclose the information collected from you to Barriq’s third-party service providers who assist in the provision of services on the Platform. By using the Platform, you consent to any such disclosure of your information with third party service providers. Barriq ensures that such third-party service providers are bound by reasonable confidentiality obligations and/or use, maintain and follow generally accepted industry and security standards and shall ensure completeness, accuracy, and consistency with respect to such information.
4.2. Barriq reserves the right to disclose your information when such disclosure is requisitioned by any governmental authority pursuant to any order, decree, judgment, notices, proceedings, rights or claims or to enforce Barriq’s Terms of Use or this Policy or to address third party violations or to protect itself or the rights of its Users.
4.3. Barriq also reserves the right to share Personal Data with their affiliates and/or third party advisors for various purposes, including investigation, prosecution, detection or prevention of any offence or contravention of any law for the time being in force such as identity theft, fraud, and/or potentially illegal activities.
4.4. Barriq may also disclose or transfer your information to any third party as a part of reorganization or a sale of the assets, division, or transfer of a part or whole of the business of Barriq. Barriq shall ensure that third-party to which it transfers or sells its assets will have appropriate confidentiality and security measures, at least as protective as those described in this Policy, to handle your Personal data. You will have the opportunity to opt out of any such transfer if the new entity's planned processing of your information differs materially from that set forth in this Policy.
4.5. A third-party payment gateway provider may be required to collect certain financial information from the User including, but not restricted to, your credit/debit card number or your bank account details (collectively referred to as “Financial Information”). All Financial Information collected from you by such third-party payment gateway provider will be used only for billing and payment processes. The Financial Information collected from you is transacted through secure digital platforms of approved payment gateways which are under encryption, thereby complying with reasonably expected technology standards. The verification of the Financial Information shall be accomplished only by you through a process of authentication in which Barriq shall have no role to play and hence, shall bear no liability in relation to the same. Barriq shall neither be liable nor responsible for any actions or inactions of third-party payment gateway providers or any breach of conditions, representations and warranties given by them. Barriq shall also not be obligated to mediate or resolve any dispute or disagreement between you and such third-party payment service providers.
4.6. Barriq reserves the right to transfer your information outside of your country. By using the Platform, you consent to such transfer of your information outside of your country and also to Barriq’s affiliates, subsidiaries and partners, provided they have agreed to ensure the same level of data protection as prescribed under this Policy and the data protection laws of India.
4.7. Barriq may keep records of telephone calls received from and made to Users for the purpose of administration of services, research and development, training, business intelligence, business development, or for user administration. Barriq may share such telephone records with third parties when required by law or when required to provide or facilitate the User with the services.
4.8The User consents to any reproduction/publishing by Barriq of testimonials and reviews given by the User on the Platform in relation to the services or the Products. The User agrees that Barriq may edit the testimonials and reviews provided by the User and reproduce/publish such edited or paraphrased versions of the testimonials and reviews on the Platform.
5. Rights of User
5.1. Privacy laws including but not limited to the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 grant individuals’ rights over their personal data. These rights allow you to control the personal data that we collect and the manner in which we use it.

Right to confirmation and accessThe right to be informed of and request access to your personal data that is collected and processed by us and request for identities of all persons with whom the Personal Data of the User has been shared.
Right to not provide data or information sought to be collected The right to not provide certain information or data that is being requested, collected, or processed on the Platform.
Right to review The right to review and check all the information including critical information and/or sensitive personal information provided to Barriq.
Right to correction, rectification, and erasureThe right to request that any incomplete or inaccurate personal data of the User be updated, completed, corrected or erased.
Right to withdraw consentThe right to withdraw consent and request that Barriq stops using, collecting, processing, handling recording or storing any Personal information in relation to the User.
It is hereby clarified that your decision to withdraw your consent will not affect the processing of Personal Data based on your previous consent prior to the withdrawal.
Right to restrictThe right to request that Barriq temporarily or permanently stops processing all or some part of the Personal Data that is provided by you.
Right to object(i) The right, at any time, to object to Barriq processing Personal Data on grounds relating to your particular situation; and
(i) The right to object to User’s Personal Data being processed for direct marketing purposes.
Right to data portabilityThe right to request a copy of your Personal Data in an electronic format and the right to have such personal data transferred or transmitted to a third-party service.
Right to grievance redressal The right to have readily available means of grievance redressal in order to resolve any issues being faced by the User.
Right to nominate The right to nominate any other individual who shall in the event of death or incapacity of the User have the right to exercise all the rights available to the User under this clause 5.
5.2. Please note that exercise of any of the above rights may, in certain cases, limit the User’s ability to access the Platform and/or purchase Products from the Platform.
6. Security
6.1. The security of your Personal Data is important to Barriq. Barriq uses generally accepted standards of technology and operational security such as Secure Sockets Layer and implements security policies, rules and technical measures, as required under applicable law including firewalls, transport layer security and other physical and electronic security measures to protect the Personal Data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. When you submit your information on the Platform, your information is protected through Barriq’s security systems.
6.2. Your information is contained within secured networks and is only accessible by a limited number of authorized persons who have access rights to such systems or otherwise require such information for the purposes provided in this Policy. These authorized persons are also under an obligation to keep such information confidential.
6.3. While Barriq endeavours to transmit and store your information including Personal Data in a secure operating environment that is not open to public, you are strongly advised to exercise reasonable discretion while providing Personal data while using the services given that the Internet is susceptible to security breaches. The User acknowledges and agrees that there is no such thing as complete security and Barriq does not guarantee that there will be no unintended disclosures of any information and potential security breaches. You agree to not hold Barriq responsible for any breach of security or for any action of any third parties that receive your Personal Data or events that are beyond the reasonable control of Barriq including, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc. Therefore, the use of the Platform will be at the own risk of the Users.
7. Cookies Policy
7.1. Cookies are small files of numbers and letters that are stored in the User's browser when they visit a website. When a user returns to the website, their browser sends these files back to the website, allowing personalised content to be shown on the User's screen.
7.2. Due to the communications standards on the Internet, when you visit, access or browse the Platform, Barriq automatically receives the uniform resource locator of the site from which you visit, access or browse the Platform, details of the website you visit on leaving the Platform, the internet protocol address of each of your computer operating system, type of web browser you use, email patterns, and the name of your internet service provider. This information is used solely to analyse overall user trends and to help Barriq improve its services. Please note that the link between the User’s IP address and the User’s Personal Data is not shared with third parties without such User’s permission or except when required by applicable law or to provide or facilitate the Services. Notwithstanding the above, the User acknowledges that Barriq reserves the right to share some of the aggregate findings, including the Personal Data in an unidentifiable, aggregate form, and not the specific data with advertisers, sponsors, investors, strategic partners, and others in order to help grow the business. The amount of information sent to Barriq depends on the settings of the web browser used by the User to access the Platform. You may refer to the browser used, if you wish to learn what information is provided to us.
7.3. Information collected by Barriq, by any means whatsoever, that does not personally identify you as an individual is exclusively owned by Barriq and may be used by Barriq and third-party service providers for technical administration of the Platform, User administration, research, development, and other purposes.
7.4. You understand that you may set or amend your web browsers to delete or disable cookies. If you choose to disable cookies on your computer or mobile telecommunication device, it may impair, degrade or restrict access to certain sections of the Platform.
7.5. Barriq may allow other companies or entities to serve advertisements to you. These companies or entities include third party advertisement servers, advertisement agencies, advertisement technology vendors and research firms. Barriq may target some advertisements to you that fit a certain general profile. Barriq does not use Personal Data to target advertisements to you. While serving advertisements or optimizing the services to its users, Barriq may allow authorised third parties to place or recognize a unique cookie on the User’s browser.
7.6. You agree and understand that Barriq does not exercise control over third party websites displayed as search results or links on the Platform. The other sites may place their own cookies or other files on the User’s computer, collect data or solicit Personal Data from the Users, on which Barriq has no control and shall not be held responsible or liable. Barriq does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Barriq guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by Barriq of such websites, the websites’ provider, or the information on the website.
8. Surveys and Contests
We Barriq may request information for contests, surveys, feedback, queries, complaints. Submissions of this information by the User is entirely voluntary and of their free will. The User can exercise his/her right and deny providing such information. Barriq undertakes this kind of information requests only in order to initiate contact with the User, if required, gather relevant data and information for the purpose of providing the Services, to inform winners of the contests, and to enable Barriq to tabulate, analyse and monitor business trends, likes, dislikes and preferences of the Users.
9. Opt-out Policy
9.1. The third-party service providers with whom Barriq may share information provided by you are permitted to market their own services or send promotional e-mails or engage in promotional communication with you. Barriq provides you with the opportunity to opt-out of receiving non-essential, promotional, or marketing-related communication from itself or its partners.
9.2. If you wish to remove your contact information from all Barriq’s lists and newsletters, you can click on the “unsubscribe” link or follow the instructions in each e-mail message.
10. Retention of Information
10.1. We will only retain your personal information for as long as necessary under applicable law and to provide our Products and Services to you. Further, we may also retain the Personal Data for essential and legitimate business purposes including carrying out contractual obligations, or for the purposes of satisfying any legal, accounting, or other regulatory reporting requirements, as may be applicable.
10.2. In the event the User exercises his/her right to erase the Personal Data provided by the User to Barriq, Barriq shall, unless such retention is necessary for compliance with applicable law, erase such personal data upon the User withdrawing his/her consent or as soon as the purpose for which data has been collected has been served.
10.3. To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the purposes for which we process the Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.
11. Grievance Redressal

12. Severability
12.1. Whenever possible, each section of this Policy shall be interpreted in a manner so as to be valid under applicable law. However, in the event any provision is held to be prohibited or invalid, such provision shall be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or other remaining provisions of this Policy.
